Terms & Conditions

Last updated: 5 September 2026

1. About these Terms

These Terms & Conditions govern access to and use of the BreinBoost website, products and educational services available through https://breinboost.co.za/.

By creating an account, making a purchase or using BreinBoost, you agree to these Terms.

BreinBoost is operated by:

Legal entity: [INSERT LEGAL BUSINESS NAME]
Legal status: [INSERT, E.G. PRIVATE COMPANY]
Registration number: [INSERT REGISTRATION NUMBER]
Registered in: South Africa
Physical address: [INSERT ADDRESS]
Address for legal notices: [INSERT ADDRESS]
Telephone: [INSERT NUMBER]
Email: [INSERT EMAIL]

In these Terms, “BreinBoost”, “we”, “us” and “our” refer to the entity identified above.

2. Parents, guardians and learners

BreinBoost provides educational services primarily for school learners in Grades 4โ€“7.

The main BreinBoost account should be created and controlled by a parent, guardian or another adult legally entitled to act on behalf of the learner.

If you create a learner profile, you confirm that:

  • you are legally entitled to create and manage the profile;
  • you may provide the learner’s personal information to BreinBoost;
  • you consent to the processing required to provide BreinBoost services where such consent is legally required; and
  • the information you provide is reasonably accurate.

Learners may use BreinBoost through an appropriately authorised account.

Parents and guardians remain responsible for supervising a child’s use of the service where appropriate.

3. The BreinBoost service

BreinBoost provides educational practice and supporting services which may include:

  • online practice examinations;
  • printable examination papers;
  • memorandums;
  • educational resources;
  • learner dashboards;
  • examination history;
  • subject and topic statistics;
  • personalised learning recommendations;
  • weekly challenges;
  • leaderboards; and
  • other educational tools made available from time to time.

Specific features depend on the Grade, Term and product purchased.

4. Educational nature of BreinBoost

BreinBoost is an independent educational practice platform.

References to CAPS alignment mean that our material is designed around topics and learning areas relevant to the South African Curriculum and Assessment Policy Statement.

BreinBoost is not the Department of Basic Education and is not a school.

Unless expressly stated otherwise, BreinBoost is not endorsed by a particular school, education department or examination authority.

Schools may teach topics in different sequences or at different times.

BreinBoost therefore does not guarantee that its material will exactly match a learner’s classroom schedule, school examination or teacher’s assessment.

5. No guarantee of academic results

BreinBoost is intended to assist learning and examination practice.

We do not guarantee:

  • a particular examination result;
  • improved school marks;
  • promotion to another Grade;
  • acceptance by a school;
  • mastery of a particular subject; or
  • any other specific academic outcome.

Results, statistics and recommendations should be used as educational guidance rather than as a substitute for professional teaching or formal educational assessment.

6. Accounts and passwords

You are responsible for keeping your BreinBoost login details secure.

You must:

  • provide reasonably accurate account information;
  • keep your password confidential;
  • prevent unauthorised access to your account; and
  • notify us if you become aware of unauthorised use.

You may not sell, rent or transfer your account to another person.

We may require password resets or other security measures where we reasonably believe an account may have been compromised.

7. Learner profiles

A parent or guardian account may support more than one learner profile where the purchased product permits this.

Each learner may maintain their own:

  • assessment history;
  • results;
  • statistics;
  • progress;
  • recommendations; and
  • challenge performance.

Access remains subject to the Grade and Term entitlement purchased.

An entitlement purchased for one Grade does not automatically provide access to another Grade.

8. Purchasing BreinBoost access

BreinBoost may sell:

  • access to an individual school Term; and
  • Full Year Access covering all four Terms for a selected Grade.

Unless clearly stated otherwise at checkout, these products are once-off purchases and not automatically renewing subscriptions.

The exact content, price and period of access applicable to your purchase will be shown on the relevant product page or checkout before payment.

9. Prices

Prices are displayed in South African rand (ZAR).

The price displayed when you place your order will apply to that transaction, subject to correction of obvious pricing or technical errors.

We may change prices for future purchases without affecting completed purchases.

Any applicable taxes, fees or other charges should be shown before the transaction is completed.

10. Payments

Payment must be completed using one of the payment methods offered during checkout.

Your order may not be activated until payment has been successfully confirmed.

Payment providers may have their own terms and conditions.

We may refuse or cancel a transaction where:

  • payment fails;
  • fraud or unauthorised activity is reasonably suspected;
  • an obvious pricing error has occurred;
  • the product is unavailable; or
  • we are legally required to do so.

If we cancel an order after receiving payment and no valid service has been supplied, an appropriate refund will be made subject to applicable law.

11. When access begins

Digital BreinBoost access will normally become available after successful purchase and account activation.

Where applicable, you may be asked to expressly request that digital services begin immediately.

Your consumer rights, including any cooling-off rights that apply to electronic transactions, remain subject to South African law.

Where a consumer expressly consents to services beginning before the end of an otherwise applicable cooling-off period, the operation of that cooling-off right may be affected to the extent permitted by law.

Nothing in these Terms removes any consumer right that cannot lawfully be excluded.

12. Cancellations and refunds

Refund and cancellation requests will be handled in accordance with applicable South African consumer law, including where relevant the Consumer Protection Act and the Electronic Communications and Transactions Act.

Whether a refund is available may depend on circumstances including:

  • when the purchase was made;
  • when access began;
  • whether the service has already been supplied;
  • whether immediate access was expressly requested;
  • whether the product is defective or materially different from what was advertised; and
  • any statutory consumer rights that apply.

To request a cancellation or refund, contact:

[INSERT SUPPORT EMAIL]

Please provide the order number and email address associated with the purchase.

Nothing in our refund arrangements limits rights that consumers are entitled to exercise under applicable law.

13. Access periods

The access included with your purchase is the access described on the relevant product page and checkout at the time of purchase.

“Full Year Access” means access to Terms 1โ€“4 of the selected Grade as described when purchased.

It does not mean an automatically renewing annual subscription unless the checkout expressly states otherwise.

We recommend keeping your purchase confirmation for your records.

14. Permitted use

BreinBoost products are supplied for personal educational use.

You may:

  • access examinations through authorised learner profiles;
  • print permitted examination papers;
  • print permitted memorandums;
  • use educational resources for the learner’s personal study; and
  • use multiple learner profiles where your purchased entitlement permits this.

You may not, without our written permission:

  • resell BreinBoost access;
  • provide your account to unrelated third parties;
  • operate BreinBoost as an unauthorised school or tutoring licence;
  • republish examination papers;
  • distribute memorandums publicly;
  • upload our paid resources to other websites;
  • reproduce substantial parts of our assessment database;
  • scrape or automatically extract our content;
  • reverse engineer protected functionality;
  • remove copyright notices; or
  • commercially exploit BreinBoost content.

15. Copyright and intellectual property

Unless otherwise stated, BreinBoost and its licensors own or have permission to use the intellectual property contained in the BreinBoost service.

This includes, where applicable:

  • examination questions;
  • memorandums;
  • learning resources;
  • written content;
  • graphics;
  • software;
  • website design;
  • branding;
  • databases;
  • assessment structures; and
  • original educational material.

Purchasing access gives you a limited right to use the relevant content for the intended educational purpose.

It does not transfer ownership of the intellectual property to you.

16. Third-party educational resources

BreinBoost may recommend videos, websites, articles or other learning resources produced by third parties.

We select external resources because we believe they may be useful, but we do not control third-party websites.

Third-party content may:

  • change;
  • become unavailable;
  • contain advertisements;
  • have its own terms or privacy practices; or
  • contain information with which BreinBoost does not necessarily agree.

A link or recommendation does not necessarily mean that BreinBoost endorses the organisation operating the external service.

17. Weekly challenges and leaderboards

BreinBoost may provide competitions, challenges and leaderboards.

Additional rules displayed with a particular challenge form part of these Terms.

Users must not:

  • manipulate challenge results;
  • use automated tools or bots;
  • deliberately exploit technical errors;
  • interfere with other participants;
  • impersonate another learner;
  • create fraudulent entries; or
  • attempt to bypass challenge limits.

BreinBoost may remove or correct a score or ranking where we reasonably believe an error, abuse or unfair activity occurred.

Leaderboard information should not contain unnecessary personal information.

18. Acceptable use

You must not use BreinBoost:

  • unlawfully;
  • fraudulently;
  • to harm another person;
  • to gain unauthorised access to systems or accounts;
  • to upload malware;
  • to interfere with website availability;
  • to circumvent access controls;
  • to harvest personal information;
  • to harass another user; or
  • in a way that could reasonably damage BreinBoost or its users.

19. Availability of the service

We aim to keep BreinBoost reasonably available but cannot guarantee uninterrupted access.

The service may occasionally be unavailable because of:

  • maintenance;
  • upgrades;
  • hosting problems;
  • internet outages;
  • security incidents;
  • third-party service failures; or
  • circumstances outside our reasonable control.

We may change, improve or replace parts of BreinBoost as the service develops.

Where practical, we will try to avoid materially reducing paid access without reasonable justification.

20. Changes to educational content

Educational material may be corrected, updated or improved.

We may change content where:

  • an error is discovered;
  • curriculum guidance changes;
  • a resource becomes outdated;
  • an external resource becomes unavailable;
  • an examination requires improvement; or
  • we introduce a better version of the material.

21. Suspension or termination

We may restrict or suspend access where we reasonably believe:

  • an account has been compromised;
  • these Terms have been seriously breached;
  • access is being resold or shared improperly;
  • fraud has occurred;
  • a user is interfering with the service;
  • another person’s rights are being infringed; or
  • suspension is necessary for security or legal reasons.

Where appropriate, we will try to give the account holder an opportunity to resolve the issue.

22. Privacy

Personal information is handled according to our Privacy Policy.

Because learner profiles involve children’s information, parents and guardians should read the Privacy Policy before creating a learner profile.

The Privacy Policy is available at:

23. Limitation of liability

Nothing in these Terms excludes or limits liability or consumer rights where doing so would be prohibited by South African law.

To the extent permitted by law, BreinBoost is not responsible for loss arising solely from:

  • a user’s failure to follow instructions;
  • unauthorised sharing of login credentials;
  • misuse of the service;
  • internet or device problems outside our control;
  • third-party websites or services outside our control; or
  • reliance on BreinBoost as a guarantee of a particular academic outcome.

BreinBoost educational material is provided as a study and practice aid and should not replace professional educational advice where such advice is required.

24. Complaints and disputes

If you have a complaint about a purchase or the BreinBoost service, please contact us first so that we have an opportunity to investigate.

Nothing in these Terms prevents a consumer from approaching an appropriate regulator, consumer body, court or other dispute resolution process available under South African law.

25. South African law

These Terms are governed by the laws of the Republic of South Africa.

The rights granted to consumers under applicable South African legislation remain applicable notwithstanding anything contained in these Terms.

26. Changes to these Terms

We may update these Terms where reasonably necessary because of:

  • changes to BreinBoost;
  • new products or features;
  • security requirements;
  • changes in law; or
  • operational changes.

The latest version will be published on the BreinBoost website and identified by the “Last updated” date.

Changes will not retrospectively remove rights relating to a completed purchase where doing so would be unlawful.

27. Electronic communications

By using BreinBoost, you agree that communications relating to your account, transactions and the operation of the service may be provided electronically.

These may include:

  • purchase confirmations;
  • account notifications;
  • password or security messages;
  • changes affecting your service; and
  • legally required notices where electronic delivery is permitted.

Marketing communications remain subject to your applicable marketing preferences.
