About these Terms<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms &amp; Conditions govern access to and use of the BreinBoost website, products and educational services available through <strong><a href=\"https:\/\/breinboost.co.za\/\">https:\/\/breinboost.co.za\/<\/a><\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By creating an account, making a purchase or using BreinBoost, you agree to these Terms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">BreinBoost is operated by:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Legal entity:<\/strong> [INSERT LEGAL BUSINESS NAME]<br><strong>Legal status:<\/strong> [INSERT, E.G. Parents, guardians and learners<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">BreinBoost provides educational services primarily for school learners in Grades 4\u20137.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The main BreinBoost account should be created and controlled by a parent, guardian or another adult legally entitled to act on behalf of the learner.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you create a learner profile, you confirm that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>you are legally entitled to create and manage the profile;<\/li>\n\n\n\n<li>you may provide the learner&#8217;s personal information to BreinBoost;<\/li>\n\n\n\n<li>you consent to the processing required to provide BreinBoost services where such consent is legally required; and<\/li>\n\n\n\n<li>the information you provide is reasonably accurate.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Learners may use BreinBoost through an appropriately authorised account.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parents and guardians remain responsible for supervising a child&#8217;s use of the service where appropriate.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">3. The BreinBoost service<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">BreinBoost provides educational practice and supporting services which may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>online practice examinations;<\/li>\n\n\n\n<li>printable examination papers;<\/li>\n\n\n\n<li>memorandums;<\/li>\n\n\n\n<li>educational resources;<\/li>\n\n\n\n<li>learner dashboards;<\/li>\n\n\n\n<li>examination history;<\/li>\n\n\n\n<li>subject and topic statistics;<\/li>\n\n\n\n<li>personalised learning recommendations;<\/li>\n\n\n\n<li>weekly challenges;<\/li>\n\n\n\n<li>leaderboards; and<\/li>\n\n\n\n<li>other educational tools made available from time to time.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Specific features depend on the Grade, Term and product purchased.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">4. Educational nature of BreinBoost<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">BreinBoost is an independent educational practice platform.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">References to CAPS alignment mean that our material is designed around topics and learning areas relevant to the South African Curriculum and Assessment Policy Statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">BreinBoost is not the Department of Basic Education and is not a school.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unless expressly stated otherwise, BreinBoost is not endorsed by a particular school, education department or examination authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Schools may teach topics in different sequences or at different times.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">BreinBoost therefore does not guarantee that its material will exactly match a learner&#8217;s classroom schedule, school examination or teacher&#8217;s assessment.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">5. No guarantee of academic results<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">BreinBoost is intended to assist learning and examination practice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We do not guarantee:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a particular examination result;<\/li>\n\n\n\n<li>improved school marks;<\/li>\n\n\n\n<li>promotion to another Grade;<\/li>\n\n\n\n<li>acceptance by a school;<\/li>\n\n\n\n<li>mastery of a particular subject; or<\/li>\n\n\n\n<li>any other specific academic outcome.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Results, statistics and recommendations should be used as educational guidance rather than as a substitute for professional teaching or formal educational assessment.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">6. Accounts and passwords<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You are responsible for keeping your BreinBoost login details secure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You must:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>provide reasonably accurate account information;<\/li>\n\n\n\n<li>keep your password confidential;<\/li>\n\n\n\n<li>prevent unauthorised access to your account; and<\/li>\n\n\n\n<li>notify us if you become aware of unauthorised use.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">You may not sell, rent or transfer your account to another person.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We may require password resets or other security measures where we reasonably believe an account may have been compromised.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">7. Learner profiles<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A parent or guardian account may support more than one learner profile where the purchased product permits this.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each learner may maintain their own:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>assessment history;<\/li>\n\n\n\n<li>results;<\/li>\n\n\n\n<li>statistics;<\/li>\n\n\n\n<li>progress;<\/li>\n\n\n\n<li>recommendations; and<\/li>\n\n\n\n<li>challenge performance.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Access remains subject to the Grade and Term entitlement purchased.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An entitlement purchased for one Grade does not automatically provide access to another Grade.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">8. Purchasing BreinBoost access<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">BreinBoost may sell:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>access to an individual school Term; and<\/li>\n\n\n\n<li>Full Year Access covering all four Terms for a selected Grade.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Unless clearly stated otherwise at checkout, these products are <strong>once-off purchases and not automatically renewing subscriptions<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The exact content, price and period of access applicable to your purchase will be shown on the relevant product page or checkout before payment.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">9. Prices<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Prices are displayed in South African rand (ZAR).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The price displayed when you place your order will apply to that transaction, subject to correction of obvious pricing or technical errors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We may change prices for future purchases without affecting completed purchases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Any applicable taxes, fees or other charges should be shown before the transaction is completed.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">10. Payments<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Payment must be completed using one of the payment methods offered during checkout.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your order may not be activated until payment has been successfully confirmed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Payment providers may have their own terms and conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We may refuse or cancel a transaction where:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>payment fails;<\/li>\n\n\n\n<li>fraud or unauthorised activity is reasonably suspected;<\/li>\n\n\n\n<li>an obvious pricing error has occurred;<\/li>\n\n\n\n<li>the product is unavailable; or<\/li>\n\n\n\n<li>we are legally required to do so.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If we cancel an order after receiving payment and no valid service has been supplied, an appropriate refund will be made subject to applicable law.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">11. When access begins<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Digital BreinBoost access will normally become available after successful purchase and account activation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where applicable, you may be asked to expressly request that digital services begin immediately.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your consumer rights, including any cooling-off rights that apply to electronic transactions, remain subject to South African law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where a consumer expressly consents to services beginning before the end of an otherwise applicable cooling-off period, the operation of that cooling-off right may be affected to the extent permitted by law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nothing in these Terms removes any consumer right that cannot lawfully be excluded.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">12. Cancellations and refunds<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Refund and cancellation requests will be handled in accordance with applicable South African consumer law, including where relevant the Consumer Protection Act and the Electronic Communications and Transactions Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whether a refund is available may depend on circumstances including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>when the purchase was made;<\/li>\n\n\n\n<li>when access began;<\/li>\n\n\n\n<li>whether the service has already been supplied;<\/li>\n\n\n\n<li>whether immediate access was expressly requested;<\/li>\n\n\n\n<li>whether the product is defective or materially different from what was advertised; and<\/li>\n\n\n\n<li>any statutory consumer rights that apply.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">To request a cancellation or refund, contact:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>[INSERT SUPPORT EMAIL]<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Please provide the order number and email address associated with the purchase.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nothing in our refund arrangements limits rights that consumers are entitled to exercise under applicable law.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">13. Access periods<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The access included with your purchase is the access described on the relevant product page and checkout at the time of purchase.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Full Year Access&#8221; means access to Terms 1\u20134 of the selected Grade as described when purchased.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It does not mean an automatically renewing annual subscription unless the checkout expressly states otherwise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We recommend keeping your purchase confirmation for your records.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">14. Permitted use<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">BreinBoost products are supplied for personal educational use.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">You may:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>access examinations through authorised learner profiles;<\/li>\n\n\n\n<li>print permitted examination papers;<\/li>\n\n\n\n<li>print permitted memorandums;<\/li>\n\n\n\n<li>use educational resources for the learner&#8217;s personal study; and<\/li>\n\n\n\n<li>use multiple learner profiles where your purchased entitlement permits this.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">You may not, without our written permission:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>resell BreinBoost access;<\/li>\n\n\n\n<li>provide your account to unrelated third parties;<\/li>\n\n\n\n<li>operate BreinBoost as an unauthorised school or tutoring licence;<\/li>\n\n\n\n<li>republish examination papers;<\/li>\n\n\n\n<li>distribute memorandums publicly;<\/li>\n\n\n\n<li>upload our paid resources to other websites;<\/li>\n\n\n\n<li>reproduce substantial parts of our assessment database;<\/li>\n\n\n\n<li>scrape or automatically extract our content;<\/li>\n\n\n\n<li>reverse engineer protected functionality;<\/li>\n\n\n\n<li>remove copyright notices; or<\/li>\n\n\n\n<li>commercially exploit BreinBoost content.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">15. Copyright and intellectual property<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Unless otherwise stated, BreinBoost and its licensors own or have permission to use the intellectual property contained in the BreinBoost service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This includes, where applicable:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>examination questions;<\/li>\n\n\n\n<li>memorandums;<\/li>\n\n\n\n<li>learning resources;<\/li>\n\n\n\n<li>written content;<\/li>\n\n\n\n<li>graphics;<\/li>\n\n\n\n<li>software;<\/li>\n\n\n\n<li>website design;<\/li>\n\n\n\n<li>branding;<\/li>\n\n\n\n<li>databases;<\/li>\n\n\n\n<li>assessment structures; and<\/li>\n\n\n\n<li>original educational material.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Purchasing access gives you a limited right to use the relevant content for the intended educational purpose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It does not transfer ownership of the intellectual property to you.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">16. Third-party educational resources<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">BreinBoost may recommend videos, websites, articles or other learning resources produced by third parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We select external resources because we believe they may be useful, but we do not control third-party websites.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Third-party content may:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>change;<\/li>\n\n\n\n<li>become unavailable;<\/li>\n\n\n\n<li>contain advertisements;<\/li>\n\n\n\n<li>have its own terms or privacy practices; or<\/li>\n\n\n\n<li>contain information with which BreinBoost does not necessarily agree.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A link or recommendation does not necessarily mean that BreinBoost endorses the organisation operating the external service.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">17. Weekly challenges and leaderboards<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">BreinBoost may provide competitions, challenges and leaderboards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Additional rules displayed with a particular challenge form part of these Terms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Users must not:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>manipulate challenge results;<\/li>\n\n\n\n<li>use automated tools or bots;<\/li>\n\n\n\n<li>deliberately exploit technical errors;<\/li>\n\n\n\n<li>interfere with other participants;<\/li>\n\n\n\n<li>impersonate another learner;<\/li>\n\n\n\n<li>create fraudulent entries; or<\/li>\n\n\n\n<li>attempt to bypass challenge limits.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">BreinBoost may remove or correct a score or ranking where we reasonably believe an error, abuse or unfair activity occurred.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Leaderboard information should not contain unnecessary personal information.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">18. Acceptable use<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">You must not use BreinBoost:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>unlawfully;<\/li>\n\n\n\n<li>fraudulently;<\/li>\n\n\n\n<li>to harm another person;<\/li>\n\n\n\n<li>to gain unauthorised access to systems or accounts;<\/li>\n\n\n\n<li>to upload malware;<\/li>\n\n\n\n<li>to interfere with website availability;<\/li>\n\n\n\n<li>to circumvent access controls;<\/li>\n\n\n\n<li>to harvest personal information;<\/li>\n\n\n\n<li>to harass another user; or<\/li>\n\n\n\n<li>in a way that could reasonably damage BreinBoost or its users.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">19. Availability of the service<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We aim to keep BreinBoost reasonably available but cannot guarantee uninterrupted access.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The service may occasionally be unavailable because of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>maintenance;<\/li>\n\n\n\n<li>upgrades;<\/li>\n\n\n\n<li>hosting problems;<\/li>\n\n\n\n<li>internet outages;<\/li>\n\n\n\n<li>security incidents;<\/li>\n\n\n\n<li>third-party service failures; or<\/li>\n\n\n\n<li>circumstances outside our reasonable control.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">We may change, improve or replace parts of BreinBoost as the service develops.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where practical, we will try to avoid materially reducing paid access without reasonable justification.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">20. Changes to educational content<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Educational material may be corrected, updated or improved.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We may change content where:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>an error is discovered;<\/li>\n\n\n\n<li>curriculum guidance changes;<\/li>\n\n\n\n<li>a resource becomes outdated;<\/li>\n\n\n\n<li>an external resource becomes unavailable;<\/li>\n\n\n\n<li>an examination requires improvement; or<\/li>\n\n\n\n<li>we introduce a better version of the material.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">21. Suspension or termination<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We may restrict or suspend access where we reasonably believe:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>an account has been compromised;<\/li>\n\n\n\n<li>these Terms have been seriously breached;<\/li>\n\n\n\n<li>access is being resold or shared improperly;<\/li>\n\n\n\n<li>fraud has occurred;<\/li>\n\n\n\n<li>a user is interfering with the service;<\/li>\n\n\n\n<li>another person&#8217;s rights are being infringed; or<\/li>\n\n\n\n<li>suspension is necessary for security or legal reasons.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Where appropriate, we will try to give the account holder an opportunity to resolve the issue.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">22.
